Abstract

Резюме: Предмет на научното изследване е фактическият състав, който е уреден в § 4, ал. 3 от ПЗР на КСО. При кумулативната даденост на неговите елементи възниква субективното право на пенсия за осигурителен стаж и възраст на лицата, които работят при условията на чл. 104, ал. 3 от кодекса (подземен труд), и чийто трудов договор е прекратен на основание чл. 328, ал. 1, т. 1 и 2 от Кодекса на труда. Анализирана е съдебната практика на Върховния административен съд.
