Abstract

Резюме: Настоящото становище е изготвено и представено на вниманието на Общото събрание на Гражданската колегия на Върховния касационен съд в отговор на поканата (изх. № ОСГК-Т.Д.-1/04.10.2010 г.) до Департамент „Право” на Нов български университет за участие в заседанието на ОСГК на ВКС на 11 ноември 2010 г. по тълкувателно дело № 1 от 2010 г. В научното изследване се предлага доктринално тълкуване на разпоредбата на чл. 61, ал. 2 от Кодекса на труда в контекста на нейните процесуалноправни измерения и въз основа на това се дава и отговор на поставените по тълкувателното дело въпроси.
