Concurrence et réglementation dans le secteur de la santé

Abstract

La concurrence peut contribuer à maîtriser les coûts et à améliorer l’efficience dans le secteur de la santé. Cette note examine les interactions entre réglementation et concurrence sur les marchés de la santé et identifie des domaines où les autorités de la concurrence peuvent plaider pour une réglementation proconcurrentielle. Elle présente un cadre permettant d’identifier et d’examiner les barrières réglementaires à la concurrence en s’appuyant sur des données empiriques et l’expérience acquise par les autorités de la concurrence à cet égard. L’analyse met en évidence que certaines règles peuvent restreindre l’entrée sur les marchés et limiter les capacités, notamment les restrictions à l’entrée fondées sur l’évaluation des besoins ou l’implication des acteurs en place aux décisions d’octroi d’agréments. La réglementation professionnelle suscite des préoccupations similaires, dans la mesure où des définitions restrictives des compétences et la faible portabilité des agréments peuvent exacerber des pénuries de personnel et réduire l’accès à la profession. Le développement des services numériques peut également être ralenti par des barrières réglementaires, notamment en raison du manque d’interopérabilité entre les systèmes de dossiers électroniques. Enfin, une réglementation proconcurrentielle peut être un appui pour les patients et les organismes payeurs en leur fournissant des informations exploitables.
