Il CNEL: coma farmacologico o coma irreversibile?

Abstract

All’indomani dell’esito dello scrutinio referendario che ha sancito, tra l’altro, la mancata abolizione del CNEL, il legislatore non potrà sottrarsi dall’affrontare il problema della sua “forzata†sopravvivenza, problema che non potrà essere esaminato esclusivamente su un mero piano di spending review, bensì, più correttamente, su quello di una sua funzionalità pensata in considerazione delle sfide che il momento corrente, caratterizzato com’è da significative se non epocali trasformazioni, lancia nel campo dell’Economia e del Lavoro. Anzi, proprio a quest’ultimo riguardo una riforma del CNEL potrebbe essere l’occasione per un ripensamento, per una ricalibratura delle politiche del lavoro, ripartendo dal ruolo fondativo costituzionalmente riconosciuto a quest’ultimo. L’A. formula delle ipotesi ma la conclusione è disincantata.
