Diecisiete mercados en busca de unidad: el futuro del mercado interior español en manos de las Comunidades Autónomas

Abstract

España, con más de 8.000 municipios, 17 Comunidades Autónomas y dos ciudades autónomas, presenta un problema estructural de fragmentación regulatoria que debilita su mercado interior y lastra la productividad. La Ley 20/2013 de Garantía de la Unidad de Mercado (LGUM) intentó abordar este problema, pero el Tribunal Constitucional anuló su principio de eficacia nacional en la STC 79/2017. Este trabajo argumenta que, tras la sentencia, la construcción efectiva del mercado interior español ha quedado fundamentalmente en manos de las Comunidades Autónomas. Si bien la STC señala la legislación sectorial estatal como vía para el establecimiento del principio de eficacia nacional, el coste político de esta opción y su alcance estrictamente sectorial la convierten en una opción poco eficiente y lenta. Las otras dos vías de avance, en particular la expansión de las leyes autonómicas de mercado abierto (LMA) y el avance del Régimen 20, dependen plenamente de la voluntad autonómica.
