Statistik vor Gericht – eine empirische Bestandsaufnahme

Abstract

Der vorliegende Beitrag geht der Fragestellung nach, ob und wenn ja, in welchem Ausmaß, statistische Aspekte eine relevante Rolle in Gerichtsverfahren in Deutschland spielen. Anhand einer Schlüsselwortsuche in der Juris-Datenbank kann gezeigt werden, dass in ca. 1.000 bis 2.000 Gerichtsurteilen (grob 2 % bis 4 % aller relevanten Gerichtsverfahren) pro Jahr statistische Begriffe vorkommen und somit erwartet werden darf, dass statistische Aspekte eine Rolle gespielt haben. Dabei ist der Anteil der Gerichtsurteile, in denen statistische Begriffe vorkamen, in den letzten Jahrzehnten deutlich gestiegen. Auf diesen Befund aufbauend werden Implikationen für die Statistik-Ausbildung abgeleitet und weitergehende Forschungsfragen aufgeworfen. Copyright Springer-Verlag Berlin Heidelberg 2014
