FinTech i FinReg - nowe wyzwania dla systemu regulacji rynku finansowego w Polsce i na świecie

Abstract

Skuteczna regulacja rynku finansowego jest kluczowa dla jego innowacyjności i przyszłej pozycji firm FinTech w branży usług finansowych. Przed globalnym kryzysem finansowym innowacje finansowe były postrzegane bardzo pozytywnie, co doprowadziło do deregulacji wielu rynków usług finansowych. W czasie kryzysu nastawienie regulatorów zmieniło się diametralnie. Szybkie zmiany technologiczne pobudziły rozwój firm z branży technologii finansowych (FinTech). FinTech i inni dostawcy usług finansowych otwarcie kwestionują obecny paradygmat regulacyjny. Organy nadzorcze coraz częściej starają się zrównoważyć tradycyjne podejście regulacyjne do stabilności finansowej i ochrony konsumentów z promowaniem wzrostu i innowacji. Wynikające z tego innowacje regulacyjne obejmują technologie, centra innowacji, piaskownice regulacyjne i inne indywidualne rozwiązania. W artykule przeanalizowano nowe podejścia regulacyjne, ustrukturyzowany eksperymentalizm (np. piaskownice regulacyjne) oraz perspektywę nowych ram regulacyjnych.
