Abstract

This paper is divided in two parts. The first part analyzes the origin of the regulation and the way of regulating the various regulatory agency functions and models. It also studies the situation in Spain and the existence of various regulatory agency attributions. On the other hand, in the second chapter there is an outline of the problem derived from deciding whose is the accountability for solving competition restricting situations in such cases as may exist in Spain, where various regulatory agencies and organs devoted to anti-trust work operate. The examples of the Commission for the National Electrical System and the Commission for the Telecommunications Market are analyzed and "de lege ferenda" proposals are made to integrate the functions of the regulatory agencies and the Anti-Trust Court.
