Mal clima organizacional institucionalizado, acoso y riesgos laborales psicosociales. Perspectiva jurídica

Abstract

Existe una nueva modalidad de acoso laboral, muy poco desarrollada por la doctrina, que surge cuando la empresa es la victimaria. Ello se aparta de la figura convencional en la que el acosador es un individuo, con características y finalidades determinadas. En este panorama, y con el mal clima organizacional como aliado silencioso, las conductas desarrolladas consciente o inconscientemente por el empresario pueden también tener consecuencias en otro tipo de riesgos psicosociales diferentes al acoso laboral institucionalizado, los cuales se ven afectados por la normativización escasa frente a estos temas, además de lo poco de jurídico y mucho de psiquiátrico, psicológico y sociológico de las normas existentes que lo convierte en poco práctico desde la perspectiva jurídica de los riesgos en el trabajo. Para la investigación se empleó el método cualitativo, ya que permite analizar los conceptos manejados transversalmente entre varias disciplinas, y el deductivo, para argumentar las conclusiones.
