Verfassungs- und sozialrechtliche Probleme einer Änderung der Beitragsbemessungsgrenze in der GKV

Abstract

Als Reformvorschlag für die Weiterentwicklung der Gesetzlichen Krankenversicherung werden von Gewerkschaften, Parteien und Verbänden verschiedene Modelle einer Bürgerversicherung vertreten. In diesen Bürgerversicherungsmodellen wird die Beitragsbemessungsgrenze unterschiedlich behandelt - die Grenze, bis zu der Beiträge vom Einkommen geleistet werden müssen. Der Autor geht aus rechtswissenschaftlicher, insbesondere verfassungs- und sozialrechtlicher Sicht der Frage nach, welchen Spielraum der Gesetzgeber bei der Gestaltung dieses Aspekts einer Bürgerversicherung hat. Ein zentraler Aspekt ist dabei der Stellenwert des Solidarprinzips und des Versicherungsprinzips in der Sozialversicherung.
