Die internationale Handelsschiedsgerichtsbarkeit aus der Sicht kleiner und mittlerer Unternehmen

Abstract

Im Binnenhandel bietet die staatliche Gerichtsbarkeit kleinen und mittleren Unternehmen (KMU) einen effektiven Rechtsschutz für ihre Transaktionen. Einen vergleichbar effektiven Rechtsschutz kann der Staat aber jenseits seiner Grenzen nur bedingt gewährleisten. Aufgrund ihrer systematischen Ähnlichkeit profiliert sich aber die internationale Handelsschiedsgerichtsbarkeit als ein funktionales Äquivalent zur staatlichen Gerichtsbarkeit. Allerdings deuten verschiedene Statistiken und Studien darauf hin, dass Schiedsgerichte vor allem für Rechtsstreite mit sehr hohem Streitwert angerufen werden. Ob auch KMU Schiedsverfahren führen, erscheint dagegen fraglich. Dennoch versuchen verschiedene führende Schiedsinstitutionen durch entsprechende Regeln, Schiedsverfahren auch für kleinere Streitwerte attraktiv zu gestalten.
