Disaggregierte Regulierung in Netzsektoren: normative und positive Theorie

Abstract

Dieser Beitrag behandelt das Zusammenspiel von normativer und positiver Theorie der Regulierung. Die regulierungsbedürftigen Netzbereiche können mit Hilfe der normativen Theorie der monopolistischen Bottlenecks lokalisiert werden. Der disaggregierte Regulierungsansatz ermöglicht es, die Regulierungsin- strumente auf Netzbereiche zu beschränken, die durch netzspezifische Marktmacht gekennzeichnet sind. Zur Regulierung netzspezifischer Marktmacht hat sich die Price-Cap-Regulierung als besonders geeignet erwiesen. Überhöhte Preisniveaus im Bereich monopolistischer Bottlenecks können durch eine gezielte Anwendung der Price-Cap-Regulierung reduziert werden. Die positive Theorie der Regulierung beschäftigt sich mit dem institutionellen Prozess der Regulierung. Der gesetzliche Regulierungsrahmen wird in Form von Gesetzen und Verordnungen im politischen Prozess festgelegt. Durch die Übertragung von Regulierungskompetenzen von einer gesetzgebenden Instanz auf eine Regulierungsbehörde wird das Regulierungsmandat festgelegt. In diesem Aufsatz werden die Grundelemente eines Regulierungsmandats im Sinne der disaggregierten Regulierungsökonomie (disaggregiertes Regulierungsmandat) vorgestellt.
