Abstract

Резюме: Предмет на настоящото изследване е правната характеристика на правото на здраве и съотношението му с правото на здравно осигуряване и правото на безплатно ползване на медицинско обслужване. Въз основа на анализа на съответните международноправни и вътрешноправни уредби се прави изводът, че липсата на изрично дефинирано „право на здраве“ в Конституцията на Република България, както и в действащото национално право, не означава непременно че такова право не съществува в националното законодателство, само че това не е направено по изричен начин и следва да бъде формулирано по тълкувателен път. Предмет на разглеждане са двете основни конституционни права по чл. 52, ал. 1 от Конституцията на Република България, в частност правото на здравно осигуряване и правото на безплатно ползване на медицинско обслужване, в основата на които е правото на здраве.
