Abstract

РЕЗЮМЕ: Разпоредбата на чл. 20 от Закона за защита от дискриминация урежда антидискриминационният аспект на един от основните институти на трудовото право – трудовата дисциплина и пряко свързаната с нея дисциплинарна отговорност. Трудовата дисциплина е един от типичните и специфични за трудовото право институти поради нейното важно обществено и правно значение. Дисциплинарната отговорност възниква при нарушение на трудовата дисциплина. Разпоредбата на чл. 20 от Закона за защита от дискриминация въвежда допълнителна правна регламентация на реализацията на тази отговорност и хода на дисциплинарното производство – фазата (стадия) на определяне от работодателя като дисциплинарнонаказващ орган на вида на дисциплинарното наказание. В чл. 20 от Закона за защита от дискриминация се урежда забраната за дискриминация при определянето (избора) от работодателя на дисциплинарното наказание.
