Distrato – O Mal Que Assombra O Setor Imobiliário

Abstract

O mercado imobiliário vem apresentado sequências de resultados negativos desde o início da crise econômica que se instaurou no país em 2014, o efeito tem sido devastador fazendo com que as empresas incorporadoras entrassem em um processo de retração, atingindo prejuízos recordes na ordem de R$7,46 bilhões e gerando no ano de 2016 somente no subsetor da Construção Civil - Construção de Edifícios –uma redução de 156.884 vagas de empregos. Assim este estudo visa entender o efeito do distrato nesse cenário, analisar os impactos financeiros, sociais, econômicos e jurídicos, verificar como outros países tratam situações semelhantes e quem são os adquirentes que solicitam o distrato e ainda demonstrar que devido ao modelo que as grandes incorporadoras do pais trabalham, associada a crise econômica financeira culminou por gerar um ciclo vicioso de aumento de estoques e redução de preços.
