Cepacs e Outorga Onerosa – Uma Análise Comparativa

Abstract

A Outorga Onerosa e os Cepacs são os instrumentos de aplicação do conceito de Solo Criado na cidade de São Paulo. Essas duas formas foram instituídas pela Lei conhecida como Estatuto da Cidade. Neste artigo essas duas formas são comparadas segundo seu funcionamento e segundo seu desenvolvimento na prática. São dois percursos que levam a resultados muito diferentes, e são levantadas hipóteses quanto às razões dessas discrepâncias. Os Cepacs adotam a forma de Valor Mobiliário, e tem sua aplicação calcada em mecanismos inspirados no mercado financeiro. De outro lado a Outorga Onerosa é pautada por mecanismos tradicionais do setor público. O caminho adotado pelos Cepacs representou um ganho significativo em relação à Outorga Onerosa uma vez que ele induz a um ambiente de menor incerteza quanto aos melhoramentos urbanos. Esta redução de incerteza contribui positivamente para as atividades de Real Estate.
