Comparaison du traitement des plaintes de discrimination en emploi par l'arbitre de griefs et le tribunal des droits de la personne du Quebec: une etude exploratoire

Abstract

Cet article presente les resultats d'une analyse comparative de 78 decisions rendues en 1992 et 1996 qui montre l'existence de differences dans le traitement des plaintes en matiere de discrimination en emploi par deux instances. Il souligne les implications de ces resultats pour les arbitres de griefs, dont le role excede de plus en plus le cadre strict de la convention collective pour embrasser l'application des droits fondamentaux dans l'entreprise syndiquee, ce qui transforme la mission initialement rattachee a cette institution des rapports collectifs du travail.
