La loi et la negociation collective de la concurrence a la complementarite

Abstract

L'auteure analyse les rapports entre la loi et la negociation collective dans le systeme des relations professionnelles, et constate la mutation profonde de ces rapports depuis environ vingt ans. La contribution que souhaite apporter Madame Morin est de preciser les donnees juridiques de ce debat afin de mieux comprendre le nouveau mode de regulation des relations de travail, et d'apprehender ses enjeux. L'auteur evolue en trois temps. Dans un premier temps, elle procede a un rappel historique du fondement du systeme de negociation collective, dans un deuxieme temps, elle situe les principaux modes d'articulation, enfin, dans un troisieme temps, elle definit les leviers d'un reordonnancement possible.
