Abstract

Freiraum ist im besiedelten wie unbesiedelten Raum eine endliche Ressource. Sie zu schützen und qualitativ zu entwickeln ist eine wichtige Aufgabe, da Freiraum durch den Menschen stetig in Anspruch genommen wird. Inwieweit diese Aufgabe auch durch das Planungs- und Umweltrecht wahrgenommen werden kann, wird im vorliegenden Beitrag erörtert. Dazu werden der bestehende Rechtsrahmen zum Thema Freiraum mit seinen Stärken und Schwächen skizziert und anschließend Ansätze zur planungsrechtlichen Stärkung des Freiraums vorgestellt.
