Abstract

Anhand von zwei Ausgangsthesen wird basierend auf der Planung und Genehmigung einer Windenergieanlage in der Gemeinde Ingersheim in der Region Stuttgart diskutiert, ob - und wenn ja, wie - es gelingen kann, die Öffentlichkeit bei der Energiewende "mitzunehmen". Der Aufsatz beschreibt die unterschiedlichen Formen und Stufen der rechtlichen Beteiligung bei der Planung und Genehmigung von Windenergieanlagen. Dabei wird der Unterschied zwischen der Bürger- und Öffentlichkeitsbeteiligung herausgearbeitet und die finanzielle Teilhabe, als ein Mittel zur Steigerung der Akzeptanz gegenüber rechtlichen Entscheidungen, vorgestellt. Im Anschluss wird das Planungs- und Genehmigungsverfahren von Windenergieanlagen dezidiert präsentiert und dabei auf baden- württembergische Spezifika eingegangen. Schließlich werden die Thesen bezugnehmend auf das Fallbeispiel erörtert.
