Verfahren und Kosten von Betriebsverlagerungen in ausgewählten europäischen Ländern: Gutachten im Auftrag der Hans-Böckler-Stiftung

Abstract

Die Verlagerung der Bochumer Produktion des Handyherstellers Nokia nach Rumänien hat in der Öffentlichkeit für erhebliches Aufsehen gesorgt.Die Ausarbeitung, die auf einem Gutachtenauftrag beruht, untersucht normativ unter Einbeziehung der Faktenlage, wie zeit- und kostenaufwändig eine solche Stilllegung in sieben europäischen Nachbarstaaten wäre. Hiermit wird die rechtliche und tatsächliche Situation in Deutschland verglichen.Vorangestellt sind die Ergebnisse der OECD-Studie zum Ende der 90er Jahre über die Wirkung von Massenentlassungen in verschiedenen europäischen und außereuropäischen Ländern und ein Überblick zur Massenentlassungsrichtlinie der EU von 1998.Abgerundet wird die Expertise durch zwei Fallstudien der Durchführung von Massenentlassungen in Schweden und in den Niederlanden.Zentrales Ergebnis der Untersuchung ist, dass Deutschland im Hinblick auf die Zeit- und Geldkosten für die Unternehmen am unteren Ende der untersuchten Länder liegt. Perspektivisch wird empfohlen, die Kompetenzen der Arbeitsagentur auszubauen und die Informationsrechte der Europäischen Betriebsräte zu Vetorechten zu verstärken.
