Regionalización de servicios públicos y propiedad municipal

Abstract

Colombia atraviesa desde hace varios años por una grave crisis en materia de agua potable y saneamiento básico, que en nuestros días ha concentrado todo tipo de esfuerzos tendientes a mejorar los niveles de calidad y cobertura. La más grande apuesta de los últimos años ha sido el esquema de regionalización denominado “Planes departamentales de agua o programa agua para la prosperidad”. Este nuevo modelo tiene una justificación económica importante, pero con fundamentos jurídicos insuficientes que difícilmente armonizan con el diseño que la Constitución Política de Colombia definió para los servicios públicos domiciliarios: libertad de entrada, libre concurrencia, competencia económica y la asignación de un rol determinante en los municipios. La presente obra hace una detallada investigación académica de dicho esquema y aborda una de las principales implicaciones del mismo, desde la perspectiva del derecho de los bienes públicos y la propiedad municipal, y pretende con ello materializar la orientación constitucional que tiene al municipio como entidad fundamental de la división político-administrativa del Estado.
