Abstract

Ein klassisches Mittel zur Begrenzung der Macht des Staates ist die Verfassung. Die Verfassungsgebung kann aber auch dazu missbraucht werden, vorhandene Macht rechtlich zu kodifizieren und zu legitimieren. Welcher Art werden die Vorschläge sein, die der so genannte „Europäische Verfassungskonvent“ der nächsten Regierungskonferenz vorlegen wird? Wird er die Macht der europäischen Institutionen beschränken oder stärken wollen?
