Effectiveness of Labour Provisions in Trade Agreements: A Qualitative Analysis of the Colombian Case

This study evaluates the qualitative effectiveness of labour provisions in Colombia’s free trade agreements with Canada and the United States. Using a four-dimensional conceptual framework encompassing the policy mix, immediate and long-term outcomes, attribution challenges and mixed-methods measurement, it finds that these provisions have strengthened state technical capacities (notably through more labour inspectors and better information systems) and enhanced workers’ political influence. However, they have largely neglected the business sector. As a result, unionisation rates have not risen significantly, nor have labour rights violations declined in any sustained way. A comparison with Mexico’s experience under the United States–Mexico–Canada Agreement (USMCA) Rapid Response Labor Mechanism suggests that more durable effectiveness requires balanced tripartite engagement (state, workers and employers) and agile dispute resolution tools capable of driving tangible improvements in working conditions within priority sectors.
