Abstract

Zusammenfassung Ende Februar 2017 hat der Bundesgerichtshof Bausparkassen, die Bausparern mit vertraglich zugesicherten hohen Einlagenzinsen aus Altverträgen vorfristig gekündigt haben, Recht gegeben. Der Autor stellt die Funktionsweise des Bausparens dar. In der aktuellen Niedrigzinsphase könnte es dazu kommen, dass der Darlehenszinssatz geringer als der Sparzinssatz ist. Dann würde das Geschäftsmodell der Bausparkassen kollabieren. Ein mikroökonomisches Modell zeigt beispielhaft, in welcher Höhe den Bausparkassen Schaden aus der Zinskonstellation entstehen können. Die betroffenen Kunden sollten von den Sparkassen in Höhe der entgangenen Nettoerträge entschädigt werden. Dies hält der Autor für eine bessere Lösung als die erlaubte vorfristige Kündigung.
