Abstract

Objective: The aim of the article is to present the results of legal and sociological research on the implementation of the participatory public management paradigm in Polish law through an analysis of the example of stakeholder participation in the process of preparing a local zoning plan based on the Act on Planning and Spatial Development, amended in 2023. Method: The dogmatic method was used to analyze the current regulations. The sociological method was used to assess the expected effectiveness of the analyzed regulations as instruments for implementing participation in spatial planning. Results: The regulations in Poland concerning the preparation of a local zoning plan do not meet the standards of participatory public management. Although the relevant chapter of the act is entitled “Social Participation†, the public consultations regulated therein are not a form of true participation at all, but only superficial activities. Furthermore, with the current regulations and their application, the interests of property owners – i.e. those with considerable resources – are always protected more strongly than the interests of other stakeholders with weaker economic positions, which in itself contradicts the idea of participation. Limitations of research and conclusions: Due to limited financial resources, no quantitative research was conducted on specific cases of attempts to implement participation in the creation of local zoning plans by municipalities. The results of the study concern the normative layer of the regulations in force, while the conclusions concerning implementation have a speculative sociological dimension. Originality/value: This publication is one of the few analyses in Poland of legal regulations concerning the functioning of public administration from the point of view of their compliance with the postulates formulated by management and quality sciences (specifically, public management science). In particular, it is not typical for Polish literature to reject consultations as a form of participation.
