Chronische Erkrankung als Merkmal einer Behinderung nach § 1 AGG

Abstract

Durch Rechtsprechungen des Europäischen G e r i c h t s h o f s ( E u G H ) k ö n n e n c h r o n i s c h e Erkrankungen auch eine Behinderung im arbeitsrechtlichen Sinne darstellen. Da das Merkmal Krankheit jedoch im deutschen Allgemeinen Gleichbehandlungsgesetz (AGG) nicht vorkommt und diese Gruppe somit bisher nicht geschützt war, gehen viele Meinungen dahin, dass durch die EuGH-Urteile nun auch chronisch Erkrankte in den Schutzbereich der Behinderten des AGG fallen. Durch Darstellung der zum Teil sehr heterogenen Begriffe „Behinderung“ und „Krankheit“ sowie der Literaturmeinung und Urteile wird in diesem Artikel gezeigt, dass ohne eine gesetzliche Änderung des AGG diese Gruppe nicht uneingeschränkt in den Schutzbereich fallen können.
