Diritti e poteri nei luoghi di lavoro. Una lettura dello Statuto dei lavoratori nel tempo della pandemia. (Rights and power on the workplace: Reading the Charter of Workers' Rights during the pandemic)

Abstract

Lo Statuto dei lavoratori è restituito al dibattito – talvolta acceso – che si svolse negli anni successivi alla sua emanazione. In quel confronto di idee si coglie la centralita' di Gino Giugni, ispiratore della legge e innovatore del diritto del lavoro. La legge 'nuova', e per qualcuno la legge “malfatta”, nasceva da approfondite riflessioni svoltesi sia all'interno del sindacato, sia in una cerchia di giuristi attenti alla comparazione e sensibili alle trasformazioni del contesto sociale. La connotazione dello Statuto come legge di rilievo costituzionale, per la peculiare sua funzione di ‘sostegno' all'attivita' sindacale nei luoghi di lavoro, nonché all'esercizio dei diritti individuali, è segno evidente di una transizione democratica verso un sistema piu' coerente di tutele. Da quell'esperienza e dal riferimento alle culture identitarie del lavoro che in quegli anni si fronteggiavano, si traggono spunti per riflettere sulla pandemia e sui riflessi che si proiettano sul lavoro, sui cambiamenti e sulle prospettive future. The article discusses the often lively debate around the Charter of Workers' Rights, which took place after its enactment. A central figure is Gino Giugni, inspirer of the Charter and an innovator in labour law. The new law, for some the "badly written" law, followed in-depth discussions both within trade unions and among law scholars who were aware of the changes in the social context. The Charter became a law of Constitutional relevance for its role of sustaining trade unions' activities on the workplace and individual rights, and it is a clear sign of democratic transition towards a more coherent system of protection. From that experience and the identity-related debates of those years, the article draws some implications for the pandemic's impact on work and on future prospects.
