Politique antitrust et politique de la concurrence dans le contexte européen - Seconde partie : les politiques anti-trust aux États-Unis et en Europe

[fre] Cet article vise à resituer les législations antitrust ou de la concurrence, en particulier la législation concurrentielle communautaire et les évolutions que l'on observe à cet égard, dans le temps et dans l'espace. Prenant une vue très longue des choses, c'est-à-dire en remontant aussi loin que possible, dans le passé, l'article montre que l'histoire de la législation de la concurrence reflète celle de l'État et de ses contradictions. Par ailleurs, l'analyse comparative permet de faire ressortir la spécificité des approches adoptées en Europe. [eng] This paper aims a putting the anti-trust or competition policies, and particulary the European competition policies and the observed evolutions in the right perspective. Taking a very long view, i.e. going as back in the past as possible, the article shows that the recent history of antitrust policy is the history of modern State and of its internal contradiction. On the other hand, the comparative analysis, highlights the specificity of the way the European Community is approaching these issues.
