L’Emission Des Billets À Ordre - Conséquences Et Implications Dans Les Relations Entre Professionnels

Abstract

Le besoin de sécurité dans la conduite des relations commerciales conduit de plus en plus de professionnels à utiliser les instruments de paiement. Les instruments de paiement sont régis par la Loi no. 58/1934 concernant la lettre de change et le billet à ordre, respectivement par a Loi no. 59/1934 concernant le chèque. Bien que la loi réglemente trois instruments de paiement : la lettre de change, le billet à ordre et le CEC, dans la pratique, l'instrument de paiement le plus utilisé ces derniers temps est le billet à ordre. Le billet à ordre est un instrument de paiement, mais en même temps c'est un moyen de garantir des obligations. Le billet à ordre est, en effet, un document par lequel une personne, nommée émetteur, s'engage à verser une somme d'argent, à l'échéance, à une autre personne nommée bénéficiaire, ou à son ordre.
