PLASAMENTELE CONSIDERATE SIGURE IN CONCEPTIA NOULUI COD CIVIL ROMAN-PRESUMED SOUND INVESTMENTS IN THE NEW ROMANIAN CIVIL CODE (Romanian version)

Abstract

The author presents the presumed sound investments from the perspective of the new Romanian code. As a persistence of his concern in the area of the new institution of administration of the property of others, the author propose a analysis of the administration forms, of the person of the administrator and off the person of the beneficiary, of their obligations regarding the presumed sound investments. There are also analyzed the investments, as well as the provisions of the new Code with reference at the application of the rules of administration of the property of others to some other different situations as: the minor’s tutorship, the curatorship, the trust and the taking possession for purpose of administration of the hypothecated property of an enterprise. The author ends the present material by showing his confidence that the taking over of the interpretations from foreign legislation with tradition in this area and their adjustment at the Romanian culture, society and juridical system will lead to concrete results for the applicability of this institutions in our country.
