Orario di lavoro a turni e work-life balance genitoriale: poteri del giudice e autonomia collettiva

Abstract

Il contributo affronta il tema del Work-life Balance in caso di orario di lavoro a turni alla luce di due significativi casi giurisprudenziali relativi, uno, alla modifica del regime di orario riguardante rapporti di lavoro a tempo pieno oggetto di contratto collettivo aziendale, ma considerato quale discriminazione collettiva; l?altro, all?indicazione dei turni di lavoro solo una volta l?anno in rapporti di lavoro a tempo parziale che il datore di lavoro riteneva legittima alla luce del Ccnl, ma ritenuto in contrasto con la disciplina di fonte legislativa, discutendo infine delle conseguenze sul versante della contrattazione collettiva dall?intervento del giudice.
