Erregulaziopeko hautaketa: errentatzaileek nola egokitzen dituzten fidantzak etxebizitzak alokatzeko merkatuetan hautemandako arriskura

Abstract

Artikulu honetan, berme-gordailuen faktore erabakigarriak aztertzen dira bizitegi-alokairuko kontratuetan, jabeek hautemandako hautaketa kaltegarriaren arriskuaren adierazle gisa. Euskal Autonomia Erkidegoko datu administratiboak erabiliz, maizterren eta jabeen ezaugarriak, osaera demografikoa, merkatuaren tamaina eta arau-aldaketak islatzen dituzten errore sendoak eta elkarrekintza-terminoak dituzten eredu lineal orokorrak estimatzen ditugu. Arreta berezia eskaintzen diogu 7/2019 Errege Dekretuak sartutako arau-aldaketari, maizterren babesa indartu eta gordailuak mugatu baitzituen. Emaitzek erakusten dute gordailuak ez daudela modu uniformean lotuta demografia- edo kontratu-ezaugarriekin; aitzitik, testuinguruaren arabera aldatzen dira, merkatuaren baldintzek, eragile instituzionalek eta erregulazioak baldintzatuta. Arrisku objektibo bat edo diskriminazio bat islatu beharrean, gordailuek hautaketa-gailu moldagarri gisa funtzionatzen dute, informazio asimetrikoko testuinguru batean. Ondorioek erregulazio uniformearen mugak eta testuinguruarekiko sentikorrak diren etxebizitza-politiken beharra adierazten dituzte.
