Las autoridades nacionales de defensa de la competencia y las jurisdicciones nacionales: principales actores en la aplicación del derecho europeo de la competencia. El caso de Francia

Abstract

The application of the Antitrust community Law in the Member States and particularly in France, has been, on one hand, attributed to the administrative authorities, the Council of Competition and the Minister of Economics (Directorate General for Competition, Consumption and Fraud Repression) and on the other hand to the national jurisdictions. The last ones have an essential role, because they are the unique competent instances to cancel illegal accords and confer indemnities to the victims. The 1/2003 Regulation aims to boost the role of the national authorities and the one of the jurisdictions at the application of the European competition law.
