Abstract

This essay tries to analyse the main problematic questions that the new regulation of the application procedure of the European competition law can imply. The new procedure is based in the Council Regulation 1/2003 that implies a directly applicable system without previous notification and based on authority descentralization. This situation can imply some problems relative to the cumulative application of the national and European system, the leniency programs and the criminal proceedings.
