Pensionsfonds für die Lastentragung der Versorgungsaufwendungen für Beamtinnen und Beamte in Bund und Ländern: eine Übersicht

Abstract

Like other pension systems in Germany, the public-sector pension scheme for civil servants at federal and state level, which is financed from public budgets, is facing major challenges as a result of demographic change. The Federal Government and several states (Länder) have attempted to counter the resulting risks and burdens for future budgets by building up pension fonds for the future pension entitlements of today’s civil servants. In this article, the legal foundations created for this purpose are presented and compared. This article presents and compares the legal foundations created for this purpose. An essential problem in this context is to secure the sustainability of this pension strategy vis-à-vis future budget legislators by suitable regulations. As future parliaments may not continue budgetary policy of their predecessors. Wie andere Altersvorsorgesysteme in Deutschland steht auch die aus den öffentlichen Haushalten finanzierte Beamtenversorgung in Bund und in den Ländern aufgrund des demografischen Wandels vor großen Herausforderungen. Der Bund und mehrere Länder haben versucht, den damit für künftige Haushalte bestehenden Risiken und Lasten zu begegnen, indem für die künftigen Altersversorgungsansprüche der heutigen Beamten Pensionsfonds aufgebaut werden. In diesem Beitrag werden die dafür geschaffenen rechtlichen Grundlagen dargestellt und verglichen. Ein wesentliches Problem ist dabei, die Nachhaltigkeit dieser Vorsorgestrategie gegenüber künftigen Haushaltsgesetzgebern mit womöglich geänderten Vorstellungen der Haushaltspolitik rechtlich abzusichern.
