The Common Agricultural Policy's New Delivery Model Post‐2020: National Administration Perspective

Abstract

This article assesses the June 2018 European Commission's legislative proposals for the Common Agricultural Policy (CAP) post‐2020. It does not consider the positions of the co‐legislators – the Council of Ministers and the European Parliament. The article considers the European Commission's New Delivery Model (NDM), the enhanced environmental and climate ambition, and the new performance framework from the perspective of a national administration. The enhanced focus on performance is the cornerstone of the NDM. However, the article highlights the complexity associated with enhanced reporting requirements of the NDM and asserts that the reporting requirements will need to be simplified and streamlined to ensure a simplified CAP for all involved; and to encourage the enhanced environmental and climate ambition foreseen in the European Commission's proposal. The move from compliance‐based to performance‐based oversight is welcomed from the perspective of the national administration. The single audit approach, whereby multiple audits and inspections are avoided, should result in simplification for the CAP beneficiaries and for the national administrations. The proposed NDM is very different to what the European Commission, national administrations and beneficiaries are used to – it will take time to bed down. Cet article analyse les propositions législatives de juin 2018 de la Commission européenne concernant la Politique Agricole Commune (PAC) après 2020. Il ne tient pas compte des positions des colégislateurs ‐ le Conseil des ministres et le Parlement européen. Cet article examine, du point de vue d'une administration nationale, le nouveau modèle de mise en œuvre de la Commission européenne, la plus grande ambition environnementale et climat et le nouveau cadre [de suivi et d’évaluation] de la performance. L'accent mis sur la performance est la pierre angulaire du nouveau modèle de mise en œuvre. Cependant, l'article met en évidence la complexité associée aux exigences de compte‐rendu renforcées du nouveau modèle de mise en œuvre et affirme que ces exigences devront être simplifiées et rationalisées afin d'assurer une PAC plus simple pour toutes les personnes concernées; et d'encourager le renforcement de l'ambition environnementale et climatique prévue dans la proposition de la Commission européenne. L'administration nationale accueille favorablement le passage d'une surveillance fondée sur la conformité à une surveillance fondée sur la performance. L'approche d'audit unique, qui évite la multiplicité des audits et des inspections, devrait aboutir à une simplification pour les bénéficiaires de la PAC et pour les administrations nationales. Le nouveau modèle de mise en œuvre proposé est très différent de ce à quoi la Commission européenne, les administrations nationales et les bénéficiaires sont habitués ‐ il faudra du temps pour s'y adapter. Dieser Artikel untersucht die Gesetzesvorschläge der Europäischen Kommission vom Juni 2018 für die Gemeinsame Agrarpolitik (GAP) nach 2020. Er berücksichtigt nicht die Positionen der Mitgesetzgeber – des Ministerrates und des Europäischen Parla‐ments. Der Artikel befasst sich mit dem neuen Fördermodell („New Delivery Model”, NDM) der Europäischen Kommission, den verstärkten Umwelt‐ und Klimazielen und dem neuen Leistungsrahmen aus der Sicht einer nationalstaatlichen Verwaltung. Ein verstärkter Fokus auf die Leistung stellt einen Grundpfeiler des NDM dar. Der Artikel hebt jedoch auch die Komplexität hervor, die mit den erhöhten Berichtsanforderungen des NDM verbunden ist. Der Artikel betont, dass die Berichtsanforderungen vereinfacht und gestrafft werden müssen, um eine vereinfachte GAP für alle Beteiligten zu gewährleisten und die im Vorschlag der Europäischen Kommission vorgesehenen verstärkten Umwelt‐ und Klimaziele zu fördern. Der Übergang von der regelkonformen (compliance‐basierten) zur leistungsorientierten Kontrolle wird aus der Sicht der einzelstaatlichen Verwaltung begrüßt. Der Single‐Audit‐Ansatz, bei dem Mehrfach‐Audits und Inspektionen vermieden werden, sollte zu einer Vereinfachung für die GAP‐Empfänger und die einzelstaatlichen Verwaltungen führen. Das vorgeschlagene NDM unterscheidet sich stark von dem, was die Europäische Kommission, die einzelstaatlichen Verwaltungen und die Leistungsempfänger gewohnt sind – es wird daher Zeit brauchen, bis es greift.
