Cumhurbaşkanlığı Hükümet Sisteminin Ortaya Çıkarabileceği Fırsatlar Ve Sorun Alanları

Abstract

16 Nisan 2017 tarihinde yapılan halkoylaması ile Türkiye, yüzyıldan fazladır uyguladığı parlamenter hükümet sistemi modelini terk ederek başkanlık modelinin bir yansıması olarak ifade edilebilecek olan Cumhurbaşkanlığı Hükümet Sistemine geçiş yapmıştır. Yeni hükümet sisteminde çift başlı yürütme yetkisi sona erdirilmiş ve Cumhurbaşkanı bizzat hem yürütmenin kendisi hem de devletin temsilcisi olmuştur. Bu sistemde kuvvetler ayrılığı prensibi ve erkler arasındaki dengeler yeniden ele alınmıştır. Özellikle yasama ve yürütme erkleri arasındaki dengeler yeni sisteme göre yeniden dizayn edilmiştir. Söz konusu değişiklikler paradigma değişikliği niteliğinde olup, derinlemesine bir incelemeyi ve literatürde tartışılmayı hak etmektedir. Bu bağlamda çalışmada öncelikle Cumhurbaşkanlığı Hükümet Sisteminin temel özellikleri ve getirdiği yenilikler ele alınmış ve bu yeniliklerin beraberinde getirdiği fırsatlar ve sorunlar tespit edilmeye çalışılmış, söz konusu fırsatların yönetim sistemine hız, esneklik ve rasyonalite katacağı sonucuna varılmıştır. Diğer yandan potansiyel sorun alanlarının ise sistemde ve uygulamada yapılacak olan revizyonlarla iyileştirilebileceği düşünülmektedir.
