Cumhurbaşkanlığı Kararnameleri ve Denetimi

Abstract

6771 sayılı Kanunla, Anayasada yapılan önemli değişikliklerden biri de, Cumhurbaşkanlığı kararnamelerine ilişkindir. Anayasa, yürütme yetkisi ile ilgili konularda düzenleme ihtiyacını karşılamak amacıyla Cumhurbaşkanına, Cumhurbaşkanlığı kararnamesi çıkarma yetkisi vermiştir. Anayasa değişikliği kanunu ile Cumhurbaşkanlığı kararnamelerinin denetimi yetkisi Anayasa Mahkemesine verilmiştir. Cumhurbaşkanlığı kararnameleri, Anayasanın 152. maddesinde yapılan değişiklikle somut norm denetimine de tabi tutulmuştur. Cumhurbaşkanlığı kararnameleri, sadece düzenleyici işlem niteliğinde olmayıp, üst düzey kamu görevlilerinin atanması ve görevlerine son verilmesi gibi bireysel idari işlem niteliğinde de olabilecektir. Ancak Anayasada bu konularda çıkarılan Cumhurbaşkanlığı kararnamelerinin idari yargı denetimine tabi olduğuna ilişkin bir hüküm bulunmamaktadır. Şu halde, özellikle bireysel işlem niteliğindeki cumhurbaşkanlığı kararnamelerinin denetimi konusunun sorunlu bir alan olduğu görülmektedir. İşte bu nedenle, çalışmamızda bu konu ele alınarak incelenmiş ve bazı çözüm önerilerinde bulunulmuştur.
