İflasın Ertelenmesi Sürecinde İyileştirme Projesi

Abstract

İflas, finansal sıkıntı yaşayan ticari şirketlerin varlığının sona ermesini ifade eder. İflasın sonuçları karşısında sadece şirketler değil; kreditörler, çalışanlar, ticari ilişkide oldukları alacaklılar ve faaliyet alanı içerisinde olduğu piyasa bile etkilenebilmektedir. İflas tehdidi ile karşı karşıya kalan bir sermaye şirketinin veya kooperatifin, iflasın ertelenmesikurumundan yararlanması halinde mali durumunun erteleme kararının verildiği zamana kıyasla daha kötü duruma gitmemesi gerekmektedir. Şirketin iyileştirme tedbirlerine kavuşarak borca batık durumdan kurtulması aynı zamanda alacaklıların haklarının korunması ve ekonomiye olan desteği birlikte hesaplandığında iflasın ertelenmesi kurumu oldukça önem arz etmektedir. Öte yandan şirketin faaliyetlerine devam etme olanağı ve üçüncü kişilerin haklarının zarar görmeme ihtimali de düşünüldüğünde iflasın ertelenmesi kurumu bir imkân olarak da değerlendirilebilir.
