Vatandaşlık Algısının Dönüşümü: Türkiye Üzerine Bir Değerlendirme

Abstract

Vatandaşlık, birey ile devlet arasındaki hukuki bağı ifade etmektedir. Anayasalarda yer alan vatandaşlık tanımları, devletlerin sahip oldukları vatandaşlık anlayışlarını göstermesi bakımından önemlidir. Antik Yunan’dan itibaren vatandaşlık meselesinin tartışıldığını söylemek mümkündür ve önemli kırılma noktaları bu kavramın taşıdığı anlamın değişmesine yol açmıştır. Önemli bir kırılma noktası olan 1789 Fransız Devrimi’nden bugüne modern vatandaşlık anlayışında bir dönüşüm yaşanmış olduğu görülmektedir. Bu durumu kamusal alanda “eşit” ve “benzer”likler üzerine kurulu Rousseau’nun vatandaşlık anlayışından, Habermas’ın gündeme taşıdığı kamusal alandaki farklılıkları görünür kılmayı amaçlayan anayasal vatandaşlık anlayışına uzanan bir süreç olarak görebiliriz. Türkiye’de de bu yönde bir dönüşüm yaşanmakta olduğu görülmektedir. Bu çalışmanın amacı dünyada yaşanan kavramsal değişime paralel olarak Türkiye’de tarihsel süreçte vatandaşlık algısında yaşanan dönüşümü göstermektir. Bu noktada vatandaşlık kavramına ilişkin yapılan anayasal düzenlemeler ele alınacaktır. Osmanlı dönemindeki anayasal gelişmeler dikkate alınmakla birlikte çalışmada esas odak nokta Cumhuriyet Dönemi anayasaları olan 1924, 1961 ve 1982 Anayasaları olacak ve anayasa çalışmaları çerçevesinde yapılan tartışmalar değerlendirilecektir.
