AB’nin Vize Politikası Bağlamında Sığınmacıların Durumu ve Türkiye-AB Geri Kabul Antlaşması

Abstract

Türkiye’nin AB ile ilişkisi, Türk hükümetinin 31 Temmuz 1959’da ortaklık başvurusunda bulunmasıyla başlamıştır. AB ülkelerine Türk vatandaşlarının vizesiz giriş hakkıyla ilgili ABAD tarafından etkili bir içtihat hukuku oluşturulmuş ancak hala AB’nin ilgili yetkililerince bu hakkı verilmemektedir. Türkiye ile AB arasında, Türk vatandaşlarının AB ülkelerine vizesiz seyahat edebilmesini öngören anlaşma 16 Aralık 2013 tarihinde imzalandı. Geri Kabul Anlaşması, AB ortak göç politikasının en önemli araçlarından biridir. Amacı negatif listedeki devletlerden gelen sığınmacılara sınırları dışında çözümler üretmek ve sığınmacılar Birlik sınırından içeri girmeden yakalayarak geri vermektir. Türkiye, Geri Kabul Anlaşması’nı imzalayarak, Türkiye üzerinden AB ülkelerine yasal olmayan yollardan giren diğer ülke vatandaşlarının Türkiye'ye geri kabulünü kabul etmiştir. Antlaşma Türkiye’yi sığınmacı kampına çevirebilecektir. Türkiye’ye getireceği yükümlülüklerle bir geri adım görüntüsündedir. Avrupa Birliği göç sorunuyla karşı karşıyadır ve bunu geri kabul anlaşmalarıyla aşmaya çalışmaktadır. Birlik ilk dönemlerindeki insan hakları perspektifinden çıkarak kendisini Avrupa kalesine dönüştürmüş ve güvenlik odaklı politikalara yönelmiştir.
