Spettri del mitico ordo: diritto e mercato nel neoliberalismo (Ghosts of mytical ordo: Law and markets in neoliberalism)

Abstract

Il tema dei rapporti tra l'ordoliberalismo tedesco e il neoliberalismo americano, già affrontato da Foucault, sembra essere particolarmente attuale. Alcuni si chiedono se le teorie ordoliberali potrebbero offrire un'alternativa allo sviluppo del sistema neoliberale degli ultimi decenni, avvenuto sotto la prevalente influenza del pensiero americano. L'autore analizza quelli che considera i tratti essenziali del neoliberalismo, con riferimento al tema dei rapporti tra diritto e mercato, e conclude nel senso che, nonostante qualche apparenza in senso contrario, l'ordoliberalismo e il neoliberalismo americano condividono alcune rilevanti concezioni di fondo, il che induce ad escludere che il pensiero ordoliberale possa offrire oggi rilevanti spunti in direzioni diverse da quelle che il sistema neoliberale ha percorso e sta percorrendo. The relationship between German Ordoliberalism and American Neoliberalism, first analyzed by Foucalt, is of special interest today. Commentators ask if Ordoliberal theories could offer an alternative to the neoliberal developments of the last few decades, shaped by American thought. The article anayzes the main traits of Neoliberalism on the issue of the relation between law and the market. The author concludes that despite appearances to the contrary, Ordoliberalism shares several relevant background assumptions with Neoliberalism, which leads to think that Ordoliberalism cannot offer a relevant alternative to the developments that neoliberalism recently went through.
