Staatstheorie: Grundzüge ihrer rechtswissenschaftlichen Diskussion in der Bundesrepublik Deutschland

Abstract

Das vorliegende Paper beobachtet die juristische Staatstheorie in der Bundesrepublik Deutschland nach dem Zweiten Weltkrieg. Der Begriff des Staats diente der Wissenschaft vom öffentlichen Recht auf verschiedenen Ebenen - Dogmatik des positiven Rechts, Staatstheorie, Methodenlehre - manchmal eher zur eigenen Abschließung, manchmal zur Öffnung gegenüber anderen Disziplinen, namentlich den Sozialwissenschaften. Diese Konjunkturen werden im paper verfolgt und Schlüsse für eine moderne, auch inderdisziplinäre Staatsrechtswissenschaft gezogen.
