Abstract

Die in den Anträgen 20/5587, 20/5405 und 20/5406 geforderten Änderungen des Betriebsverfassungsgesetzes sind empirisch nicht fundiert und können auch mit Blick auf grundsätzliche ökonomische Überlegungen nicht überzeugen. Dies gilt für alle den Anträgen offenkundig zugrundeliegenden Annahmen der Antragstellerin, dass erstens der Verbreitungsgrad von Betriebsräten alleiniger Maßstab für die Partizipation von Beschäftigten sei und ein geringerer Verbreitungsgrad demzufolge ein Partizipationsdefizit anzeige, zweitens Beschäftigte auf die Einrichtung von Betriebsräten aufgrund adversen Verhaltens des Arbeitgebers verzichten würden, was zu dem geringen Verbreitungsgrad beitrage und drittens die Mitbestimmungsrechte im Betriebsverfassungsgesetz nicht ausreichen würden, um die Interessen der Beschäftigten angemessen zu vertreten. Die Forderungen sind daher abzulehnen.
