Abstract

Die Anträge 20/6003 und 20/5978 fordern eine Änderung des §8 Arbeitnehmerüberlassungsgesetz (AÜG) dahingehend, dass die Möglichkeit der Abweichung vom "equal-pay-Prinzip" gemäß §8(1) AÜG durch Anwendung eines Tarifvertrages nicht mehr möglich sein solle. In der Folge wäre an überlassene Arbeitnehmer der gleiche Lohn zu zahlen und es wären die gleichen Arbeitsbedingungen zu gewährleisten wie für vergleichbare Arbeitnehmer des Einsatzbetriebes. Zusätzlich fordern beide Anträge einen gesetzlich festgelegten "Flexibilitätszuschlag" von 10 Prozent. Antrag 20/6003 beschränkt diese Forderungen indes auf Fremdpersonal in der Branche Post-, Kurier- und Expressdienste. In Antrag 20/6003 wird darüber hinaus eine Begrenzung des Einsatzes von Fremdpersonal in der Branche Post-, Kurier- und Expressdienste auf 15 Prozent der dort Beschäftigten gefordert.
