Vertretungsbefugnis im Verbraucherinsolvenzverfahren – eine Aufgabe für die Schuldner- und Insolvenzberatung!

Abstract

Seit dem 01. Juli 2014 regelt die Insolvenzordnung, dass die Schuldnerberatungsstellen (in ihrer Funktion als geeignete Stellen gem. § 305 InsO) den*die Schuldner*in auch vor dem Insolvenzgericht vertreten können. Seither wird immer wieder – auch unter den Beratungsfachkräften und Trägern der Beratungsstellen – diskutiert, ob und unter welchen Bedingungen die Übernahme der gerichtlichen Vertretung sinnvoll ist. Meine Ausführungen sollen dazu beitragen, das Thema "gerichtliche Vertretung" wieder mehr in den Fokus zu nehmen und von verschiedenen Seiten zu beleuchten.
