Policy-Transfer in der EU-Erweiterungs- und Nachbarschaftspolitik: Einblicke aus einer Analyse deutscher Justiz-Twinnings

Abstract

"Twinning" zielt als etabliertes Instrument der Europäischen Kommission darauf ab, im Rahmen der EU-Erweiterungs- und Nachbarschaftspolitik Reformprozesse anzustoßen. Durch bilaterale Partnerschaften sollen öffentliche Strukturen mit Blick auf EU-Standards aufgebaut werden. Im Sinne des für die EU-Außenbeziehungen zentralen Gedankens der Rechts-staatlichkeit sind Twinnings im Bereich des Justizsektors von besonderer Relevanz. Am Beispiel der Justiz-Twinnings lässt sich eine Veränderung dieses Instruments nachzeichnen: Was als Kollegialinstrument der EU-Erweiterungspolitik begann, entwickelte sich sukzessive zu einem die Rechtsstaatlichkeit fördernden Generalinstrument der EU-Außenbeziehungen. Justiz-Twinnings sind durch einen stetig wachsenden Wettbewerb der Mitgliedsstaaten geprägt. Das Ziel, europäische Rechtsstaatsprinzipien zu etablieren, umfasst nicht nur Inhalte und Funktionsweisen der Justiz, sondern auch das "Mindset" für rechtsstaatliches Handeln. Problematisch ist die teilweise mangelnde Nachhaltigkeit. Aus deutscher Perspektive ist eine deutliche Verbesserung der dienstrechtlichen Wertschätzung und Anerkennung von Twinning-Einsätzen von öffentlichen Bediensteten notwendig.
