Die Westbalkanregelung im Bausektor: Zu den Folgen eines niedrigschwelligen Migrationsweges für die Rechte der Beschäftigten

Abstract

Die Westbalkanregelung bietet Staatsangehörigen aus Albanien, Bosnien und Herzegowina, Kosovo, Nordmazedonien, Montenegro und Serbien einen niedrigschwelligen und kontingentierten Zugang zum deutschen Arbeitsmarkt. Auf der rechtlichen Ebene weist die Regelung einige Besonderheiten auf. Die vorliegende Untersuchung fragt nach den Effekten der Westbalkanregelung auf die Rechte der Beschäftigten und konzentriert sich dabei auf den Bausektor. Auf Grundlage von Expert*innen-Interviews und einer Fokusgruppendiskussion mit sechs Arbeitsrechtsberater*innen identifiziert sie positive und negative Auswirkungen der Westbalkanregelung auf die Rechte von Beschäftigten und formuliert Handlungsempfehlungen.
