Hukum E-commerce dalam Perspektif Islam

Abstract

Tujuan penelitian ini adalah untuk mengkaji lebih mendalam mengenai hukum E-commerce dalam perspektif Islam dengan berdasarkan ayat-ayat Al-Quran serta tafsirnya dan ijtihad para ulama. Penelitian ini merupakan penelitian kepustakaan (library research) dengan metode istinbath hukum yaitu bagaimana pembahasan mengenai sumber-sumber hukum dan metode penggalian hukumnya. Hasil penelitian ini menunjukkan bahwa E-commerce memiliki kesamaan dengan bai’ as-salam yaitu mengenai unsur-unsur terjadinya transaksi serta adanya penangguhan barang untuk pembayaran yang telah disegerakan. Maka pandangan hukum Islam pada jual beli ecommerce adalah boleh, jika sesuai dengan kaidah fikih dalam prinsip dasar transaksi muamalah serta persyaratannya, selama tidak melanggar syariah atau bertentangan dengan dalil.
